Olympics Live Shop – Terms and Conditions

Thank you for visiting the Olympics Live Shop (olympicsliveshop.com.au) (“the Website”). This Website is owned by the Australian Olympic Committee Inc (ARBN 052 258 241) and operated by Sold Out National Event Management Pty Ltd (ABN 45 062 109 568).

By accessing and/or using this Website to register to become an Olympics Live site (Olympics Live Site) or to purchase or obtain Olympic assets to create your own Olympics Live event (Olympics Live Event), you agree to these Terms and Conditions, which include our Privacy Policy (available at www.olympics.com.au) (Terms). You should review our Privacy Policy and these Terms carefully and immediately cease using our Website if you do not agree to these Terms. In these Terms, ‘us’, ‘we’ and ‘our’ means the Australian Olympic Committee Inc. You acknowledge that these Terms are subject to change.

1 Registration as an Olympics Live Site
You agree that any information you provide us about yourself, your proposed event or site when registering to be an Olympics Live Site will be true, accurate, current and complete and that you will ensure that this information is kept accurate and up to date. If incorrect information is supplied to us, any contractual obligation we have is immediately null and void.

When you register to become an Olympics Live Site you must elect whether your site and event will be at a private home or elsewhere (including at a business premises, community venue or other public venue).

If you notify us that your Olympics Live Site will be at a “private home” you warrant that your Olympics Live Event will in fact be at a private residence, that you will not promote your Olympics Live Event as open to the public, you will not sell any tickets to your Olympics Live Event or otherwise commercialise your Olympics Live Event in any way.

If you notify us that your Olympics Live Site will be at a non-private home (including at a business premises, community venue or other public venue), you will be required to complete and electronically sign an “Olympics Live Site Agreement” for Seven and an “Olympics Live Assets Agreement” for the AOC (Olympics Live Documentation) which together set out further terms and conditions about being an Olympics Live Event and conducting the live site screen of the Tokyo 2020 Olympic Games, in order to complete your registration.

We retain the right to refuse any request for registration to be an Olympics Live Site for any reason and associated request to purchase or obtain any Olympics Live assets.

If you are under 18, you must ask your parents or guardians before you register to be an Olympics Live Site or and you must ask for your parents or guardians to purchase the Olympics Live assets on your behalf from the Olympics Live Shop. By continuing to use this Website and any of the products offered, you are confirming that you have received the consent of your parents or a guardian. PLEASE NOTE that all minors are recommended to discuss these terms and conditions with their parents before they complete the registration process.

2. Terms of Sale
By placing an order on the Olympics Live Shop you are offering to purchase a product subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

Dispatch times may vary according to availability and subject to any delays resulting from postal delays or force majeure for which we will not be responsible.

(a) Our Contract
In order to contract with the Olympics Live Shop you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. All prices advertised are subject to such changes.

When you place an order for Olympics Live Assets, you will receive an acknowledgement e-mail acknowledging receipt of your order: this email will only be an acknowledgement only and will not constitute acceptance of your order or registration to become an Olympics Live Site.

If your registration to become an Olympics Live Site is approved (and in the case of proposed Olympics Live Sites which are not “private homes”, we have received the signed Olympics Live Documentation) we will inform you by email and proceed to process any payment using our preferred provider Stripe Payments Australia Pty Ltd (ACN 160 180 343).

(b) Pricing and Availability
Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

Delivery costs (which will be clearly displayed where applicable) will be charged in addition to the price of the good.

(c) Payment
Upon receiving your order we carry out a standard authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Your card will be debited upon authorisation being received and your registration to become an Olympics Live Site being approved by us. The monies received upon the debiting of your card shall be treated as a deposit against the value of the goods you wish to purchase. Once the goods have been dispatched and you have been sent a confirmation email the monies paid as a deposit shall be used as consideration for the value of goods you have purchased as listed in the confirmation email.

3. Cookies
The AOC, our third party partners, sponsors and service providers may use files known as cookies and other technologies to collect information about your use of the AOC website. We may also share such information in relation to use of this Website with our corporate partners, licensees, sponsors, suppliers and broadcasters. These technologies allow the AOC and such third parties to evaluate your use of this Website to provide services relating to website activity and internet usage. The services the AOC may use from time to time include Google Tag Manager and Facebook Pixel. You can find more details in the privacy policies for those services, including for information on how to opt-out of certain conduct. You can configure your web browser software to reject cookies, however some parts of this website may not have full functionality in that case.

4. Accuracy, completeness and timeliness of information
While we use all reasonable attempts to ensure the accuracy and completeness of the information on this Website, to the extent permitted by law, including the Australian Consumer Law, we make no warranty regarding the information on this Website. You should monitor any changes to the information contained on this Website.
We are not liable to you or anyone else if interference with or damage to your computer systems occurs in connection with the use of this Website or a linked Website. You must take your own precautions to ensure that whatever you select for your use of this Website is free of viruses or anything else (such as worms or Trojan horses) that may interfere with or damage the operations of your computer systems.
We may, from time to time and without notice, change or add to this Website (including these Terms) or the information, products or services described in it. However, we do not undertake to keep this Website updated. We are not liable to you or anyone else if errors occur in the information on this Website or if that information is not up-to-date. We are also not liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this Website.

This Website may contain links to websites operated by the AOC or third parties, including websites where you may purchase Australian Olympic Team merchandise. Those links are provided for convenience and may not remain current or be maintained. Unless expressly stated otherwise, we do not endorse and are not responsible for the content on those linked websites and have no control over or rights in those linked websites. Your use of the linked website will be subject to the terms of use of that website.

6. Intellectual property rights
Unless otherwise indicated, we own or license from third parties all rights, title and interest (including copyright, designs, patents, trademarks and other intellectual property rights) in this Website and in all of the material (including all text, graphics, logos, audio and software) made available on this Website (Content).
Your use of this Website and use of and access to any Content does not grant or transfer any rights, title or interest to you in relation to this Website or the Content. However, we do grant you a licence to access this Website and view the Content in accordance with these Terms and, where applicable, as expressly authorised by us and/or our third party licensors.
Information made available through this Website is confidential in nature (unless advised otherwise or it is already in the public domain) and must not be disclosed to a third party without the our prior written consent.
Any reproduction or redistribution of this Website or the Content is prohibited and may result in civil and criminal penalties. In addition, you must not copy the Content to any other server, location or support for publication, reproduction or distribution is expressly prohibited.

Except to the extent your Olympics Live Event forms part of your ordinary business or is otherwise approved by the AOC, this Website and the Olympics Live assets which you may obtain or purchase from this Website are for your personal or non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell any Content, software, products or services contained within this Website and any of the Olympics Live assets obtained or purchases on this Website. You may not use this Website, or any of its Content, to further any commercial purpose, including any advertising or advertising revenue generation activity on your own Website.

8. Unacceptable activity
You must not do any act that we would deem to be inappropriate, is unlawful or is prohibited by any laws applicable to this Website, including but not limited to:
any act that would constitute a breach of either the privacy (including uploading private or personal information without an individual’s consent) or any other of the legal rights of individuals;
using this Website to defame or libel us, our employees or other individuals;
uploading files that contain viruses that may cause damage to our property or the property of other individuals;

We reserve the right to restrict, suspend or terminate without notice your access to this Website, any Content, or any feature of this Website at any time without notice and we will not be responsible for any loss, cost, damage or liability that may arise as a result.

To the maximum extent permitted by law, including the Australian Consumer Law, in no event shall we be liable for any damages whatsoever, including but without limitation, for any direct and indirect loss, damage or expense (including consequential, punitive or incidental damages, or damages for loss of profits, damage to goodwill or reputation or the cost of procurement of substitute goods) – irrespective of the manner in which it occurs – which may be suffered due to your use of this Website and/or the information or materials contained on it (including the Olympics Live assets), or as a result of the inaccessibility of this Website and/or the fact that certain information or materials contained on it are incorrect, incomplete or not up-to-date.

11. Jurisdiction and governing law
Your use of the website and these Terms are governed by the law of New South Wales and you submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in New South Wales.
